Terms of Use

If you already had a HollaSea account before 30 September 2026, this version applies to you from 15 October 2026. Until then, the previous version applies to you.
These Terms of Use ("Terms") govern your use of the website hollasea.com and its services (together, the "Platform"). The Platform is operated by HOLLASEA S.R.L. ("HollaSea", "we", "us" or "our").
These Terms become a contract between you and HollaSea when you accept them: by ticking the box when you create an account, or before you pay for a boat booking. Sections 9, 11 and 12 also apply to visitors who use the Platform without an account. Please save or print a copy of these Terms.
Our Cancellation & Refund Policy forms part of these Terms. It explains in full what happens to payments made to HollaSea if your plans change. If it differs from these Terms on cancellations, refunds or withdrawal, the Cancellation & Refund Policy applies, unless these Terms are more favourable to you.
Our Privacy Policy explains how we use personal data, and our Cookie Policy explains how we use cookies. They give you information. They are not terms you agree to.
In these Terms:
- a "member" is anyone with a HollaSea account;
- a "skipper" is a member with a skipper account;
- "crew" means members who join or look for voyages, as crew or as passengers;
- a "charter company" is a business that rents out boats;
- a "skipper ad" is an ad in which a charter company looks for a skipper.
1. Who We Are

2. What HollaSea Is and Our Role
2.1 An online platform
HollaSea is an online platform. It acts as an intermediary that brings together members, skippers and charter companies. On HollaSea you can:
- find boats offered by independent charter companies, and request, hold or reserve them (Section 4);
- join voyages organised by skippers, or post your own voyages if you are a skipper (Section 6);
- reserve a skipper for the dates they are free, or post a request and receive offers from skippers (Section 6);
- post skipper ads if you have a charter company account, or apply to them if you are a skipper (Section 6);
- buy HollaSea's own services: skipper membership, request publication, Featured placements and vouchers (Section 7).
2.2 HollaSea does not own or operate boats
HollaSea does not own, manage, maintain, operate, crew or insure any boat shown on the Platform.
2.3 Our role in boat charters
Boats, their availability and their prices come from independent charter companies and their booking systems. The charter contract is between you and the charter company. HollaSea:
- passes your request, hold or reservation to the charter company's booking system;
- collects the payments for your reservation; and
- issues its invoice for each payment you make to HollaSea.
The charter company provides the boat. It is responsible for the charter itself: the handover and return of the boat, check-in, the condition of the boat, its safety equipment, the security deposit and the extras paid at the base. At check-in, you sign the charter company's documents directly with it.
The boat page shows the name of the charter company when its booking system provides it. If the name is not shown, or you want the charter company's full contact details, ask us before you pay and we will give them to you.
2.4 Our role in voyages, skipper hire, requests and skipper ads
For these services, HollaSea provides the tools that let members find each other and talk. Any agreement is made directly between the members involved: for example, joining a voyage, hiring a skipper, accepting an offer or taking a job from a skipper ad. HollaSea is not a party to these agreements. It does not organise voyages, takes no commission, and does not collect or hold any payment for them.
2.5 Who you are dealing with
Charter companies are businesses. Skippers and other members may be private individuals, or they may act as a business (a "trader"). HollaSea does not currently ask skippers to declare which they are, and does not check it. Ask the skipper before you agree to anything.
- If the skipper acts as a trader, you have the rights that EU consumer law gives you against that skipper.
- If the skipper is a private individual, EU consumer protection law does not apply to your agreement with them.
3. Accounts, Registration and Eligibility
3.1 Account types
- Crew and passengers: people who want to join voyages, reserve a skipper, post requests or book boats.
- Skippers: people who post voyages, share their free dates and send offers. Skippers can also book boats.
- Charter companies: businesses that create a company profile and post skipper ads, for example for deliveries, transfers or charters. When they register, they give their company name, VAT or registration number, country and phone number.
3.2 Age
You must be at least 18 years old to create an account or make a booking. You confirm this when you register.
3.3 Accurate information and account security
Give accurate, current and complete information, and keep it up to date. Some actions need your name, phone number, address and country: applying to a voyage, posting a voyage or a request, applying to a skipper ad, and requesting, holding or reserving a boat. When you pay HollaSea, your name and address appear on the invoice.
Keep your password confidential. Tell us straight away at office@hollasea.com if you think someone else is using your account.
3.4 Skippers
When you register as a skipper, you declare that you hold the licence needed to navigate in the waters where you sail, and that you will provide the documents that government authorities ask for. When you list certifications on your profile, you confirm that they are genuine and accurate.
Before you post a voyage, share your free dates, send offers or manage your membership, you must accept the HollaSea Skipper Agreement. It adds to these Terms. If the Skipper Agreement conflicts with these Terms, the provision more favourable to you applies. Nothing in the Skipper Agreement limits any liability described in Section 15.3, or your rights under Section 17. Posting voyages, sharing free dates and sending offers also need an active membership (Section 7.2).
3.5 We do not verify licences or qualifications
Skippers may list their licences and qualifications (for example RYA Yachtmaster, Day Skipper, ICC or commercial endorsements), their sea miles and their experience. HollaSea does not check, verify or guarantee that any licence, certificate, qualification or experience a member states is authentic, accurate or legally valid. Badges, tags and profile details show what the member has declared. They are not a verification by HollaSea.
By selecting certifications, licences or qualifications on your profile, you confirm that they are genuine and accurate.
3.6 Check before you sail
- Charter companies that engage a skipper through the Platform must do their own checks: inspect the original licences, check insurance and make sure that all maritime law requirements are met.
- Crew and passengers decide for themselves whether to join a voyage. Before departure, we strongly recommend that you check the skipper's original licence, the boat's registration and its safety equipment, and that you have suitable travel and medical insurance.
4. Boat Charters: Booking, Payments and Cancellations
4.1 Prices and what you see before you pay
Boat availability and prices come from the charter companies' booking systems. They can change until your reservation is made. The discounts shown are those the charter company applies to its own list price.
Before you pay, the payment window shows:
- the total price of the charter, VAT included where applicable;
- the charter company's payment schedule (how much is due and when) and its terms;
- how much you pay now and how much is left to pay later;
- the deadline for your first payment.
The charter company's cancellation conditions are part of the charter contract. They are not shown in the payment window: before you pay, ask us at office@hollasea.com and we will send them to you.
The boat page and your offer show the security deposit and the extras and fees that are paid at the base.
4.2 Request, Hold and Reserve
- Request an offer: free, with no obligation. You receive the charter company's price and conditions for your dates. We do not send your personal details to the charter company for a request.
- Hold (where available): free. The boat is kept for you until the expiry date and time set by the charter company, shown on the Platform and in your email. You can cancel a hold at any time. If you do nothing, it expires and you pay nothing.
- Reserve: clicking "Reserve" does not yet oblige you to pay. The boat is kept for you for a short payment window. The deadline is shown in the payment window and in our email. If no payment reaches us by then, the reservation is released automatically, at no cost to you.
When you hold or reserve a boat, we send your name, email address, phone number and address to the charter company so it can register the booking. The charter company may then email you directly about it. See our Privacy Policy for details.
4.3 How a boat booking is made
- Choose the boat and your dates, and tell us who will skipper the boat (Section 5.2).
- Choose "Reserve" and open the payment window. Check the summary. If something is not right, close the window before you pay and change your choice. You can correct your contact details in your profile.
- Tick the confirmations (Section 4.8) and pay.
- Your booking becomes firm when we receive your first payment and the charter company confirms the reservation. We email you when we receive each payment.
Contracts on the Platform are made in English. We keep a record of your bookings, your payments and when you accepted these Terms. You can see your bookings and payments in My Activity.
4.4 Paying through HollaSea
For a boat booked on the Platform, you pay HollaSea, unless we agree otherwise with you in writing.
- With your first payment, you choose to pay either the first instalment of the charter company's payment schedule or the full amount. If your dates are close, the schedule may require the full amount at booking.
- You pay any later instalments through the Platform by the due dates in the schedule. We aim to send you an email reminder before each due date.
- If an instalment is not paid on time, the reservation is marked as overdue and we email you. HollaSea does not cancel it automatically. If the instalment stays unpaid, the charter company may cancel the reservation under its conditions. Section 4.9 then applies.
4.5 Payment methods
- Card: by card, or another method shown in Stripe's payment form, processed by our payment provider, Stripe. You enter your card details directly with Stripe. HollaSea never sees or stores your card number.
- Bank transfer, where offered: to HollaSea's bank account shown in the payment window, with the payment reference shown there. A transfer counts as paid on the day the money reaches our account. Always use the payment reference shown there, so that we can match it to your booking. Transfers can take one or more business days, so allow enough time before the deadline.
We do not accept payment in any other way. For a boat booked on HollaSea, never send money to any other account.
If your payment reaches us after the reservation was released, or we cannot match it to a booking, we contact you. Within 14 days, we either refund it in full to the account or card it came from or, if you agree and the boat is still available, use it for a new booking.
4.6 Invoices
HollaSea issues an invoice for each payment you make to HollaSea and sends it to you by email.
4.7 Payments at the base
You pay the security deposit, and the extras and fees shown as paid at the base, directly to the charter company at check-in, under its conditions. The charter company returns the security deposit under its conditions. You (or your skipper) and the charter company sign the handover, check-in and condition reports directly.
4.8 What you confirm before each payment
Before each payment, you tick three confirmations. Their exact wording is:
- "I understand that the boat is blocked for me as soon as it is paid, and that if I cancel, the amount I have paid is not refunded, except as set out in the Terms of Use and the Cancellation & Refund Policy."
- "I agree to the Terms of Use and the Cancellation & Refund Policy, and I have read the Privacy Policy."
- "I understand that, unless I have agreed with a skipper who will come to check-in, I am responsible for bringing a skipper who holds the required licences, and that if the boat is not handed over for this reason, the charter company's cancellation conditions apply."
These confirmations do not take away any right you have under these Terms or under the law. They do not remove any liability that cannot be excluded by law (Section 15.3).
4.9 Cancellations and refunds
The full rules are in our Cancellation & Refund Policy. In short:
- Before you pay: you can cancel a request, a hold or an unpaid reservation in My Activity at no cost.
- No 14-day right of withdrawal: a boat charter is a leisure service booked for specific dates. The 14-day right of withdrawal for online and other distance contracts does not apply to it (Article 16 letter l) of Government Emergency Ordinance no. 34/2014).
- If you cancel after paying: the amount you have paid is not refunded, except where the charter company's cancellation conditions made available to you before you paid, or mandatory law, provide otherwise. HollaSea adds no cancellation charge of its own. If those conditions give you a refund, or the charter company agrees to a refund, a credit or a change of dates, we pass it on to you in full. We do this within 14 days of the charter company confirming it or, if the money must first come back from the charter company, within 14 days of receiving it. Whether you still owe instalments that were not yet due also depends on those conditions. To cancel, email office@hollasea.com.
- No-show or unpaid instalment: the same rules apply if you do not show up at the base, or if you do not pay a later instalment and the charter company cancels because of it.
- If the charter company cancels, the boat is not available, or we cannot confirm your reservation after you have paid: we refund everything you paid to HollaSea for that reservation, at no cost to you, to the payment method you used, within 14 days. We may offer you a replacement boat or new dates instead, but you are free to refuse and get the refund.
- Late bank transfers: see Section 4.5.
5. Skippers and Licences for Boat Charters
5.1 Licence requirements
If you charter a boat without a professional crew (a "bareboat" charter), the person who will skipper the boat must present at check-in the licences and certificates required by the charter company and by the destination country. These often include an International Certificate of Competence (ICC) or an equivalent national licence, and may include other certificates, such as a radio operator's certificate. Ask us for the charter company's conditions before you pay.
5.2 Who will skipper the boat
When a boat needs a licensed skipper, the boat page asks you who will skipper it, before you request, hold or reserve it. You choose one of these options:
- Crewed (I need a skipper for this boat, for these dates): we tell skippers on HollaSea who are free for your dates when you hold the boat, or once your reservation is confirmed after your first payment. They can then send you offers. If you only request an offer for the boat, no skipper is contacted. This request is not sent to the charter company. Any agreement with a skipper is made directly with that skipper (Section 6).
- Bareboat (I will skipper the boat myself): you skipper the boat yourself or bring your own skipper, who must hold the licences described in Section 5.1.
HollaSea does not provide skippers, and it cannot guarantee that a skipper will send you an offer. Unless you have agreed with a skipper who will come to check-in, you are responsible for bringing a skipper who holds the required licences.
5.3 If the boat is not handed over
The charter company may refuse to hand over the boat if the skipper cannot show a valid licence, if documents that the charter company or the local authorities require at check-in are missing, or if the skipper clearly cannot handle the boat safely. HollaSea does not collect these documents.
If the refusal is justified under the charter company's conditions made available to you before you paid, it counts as a cancellation by you, and those conditions apply (Section 4.9). This can mean losing up to the full charter price.
If you think the refusal was not justified, tell us straight away. We will pass your complaint to the charter company. Your rights against the charter company are not affected, and neither is your legal right to dispute a card payment with your bank.
5.4 Insurance
We strongly recommend that you take out travel, trip-cancellation and skipper liability insurance.
6. Voyages, Skipper Hire, Requests and Skipper Ads
6.1 Voyages
Skippers create voyages. They set the route, the dates, the number of spots, the cost of a spot and the other conditions. Crew apply to join, and the skipper decides whom to accept.
A voyage application may ask for health or dietary information, such as allergies. Filling it in is optional. What you write there is shared only with the skipper of that voyage, for your safety on board.
6.2 You pay for voyages directly to the skipper
The skipper sets the cost of a spot and states what it includes (for example, the share of the boat and the skipper's fee). Costs that are not included, such as fuel, provisions and marina fees, are agreed with the skipper and split on board. You pay the skipper directly.
HollaSea does not collect, hold or refund any payment for voyages, and takes no commission. Cancellations, changes and refunds are between the skipper and the crew. Before you travel, agree the key points in writing in the HollaSea chat: the price, what it includes, the shared costs and the cancellation terms.
6.3 Safety and responsibility on board
The skipper is responsible for:
- the boat and the safety of everyone on board;
- holding the licences and insurance required;
- following the rules that apply to carrying crew or passengers in the waters sailed.
The skipper has final authority on board on safety matters. Crew must follow the skipper's safety instructions, and are responsible for their own conduct and belongings. We recommend that crew have their own travel and medical insurance.
6.4 Reserving a skipper
Skippers can share the dates when they are free and a price per day. That price is the skipper's own indication. When you reserve a skipper and the skipper confirms, the skipper's contact details are shared with you in the chat, so you can finalise the arrangement. You agree the final price and the payment directly with the skipper. HollaSea does not take payment for skipper hire and takes no commission.
6.5 Requests and offers
Crew and passengers can post a request: either a full voyage request or a skipper-only request. Publishing a request costs a one-time fee (Section 7.3). Skippers with an active membership can send offers. Any cost estimate shown with a request is only an indication. If you accept an offer, the agreement, the price and the payment are directly between you and the skipper. The same applies to offers that skippers send to members who have booked a boat and asked for a skipper.
6.6 Skipper ads
Charter companies can post skipper ads, and skippers can apply. The charter company and the skipper agree the engagement, the pay and the conditions directly. Each of them is responsible for following the employment, tax and maritime rules that apply.
6.7 HollaSea is not a party
In all the cases in this Section, HollaSea is not a party to the agreement between members. It does not organise the voyage and does not act as agent or insurer for either side. It is not responsible for how the agreement is carried out. This does not limit our responsibility for our own services under these Terms, or any rights you have under mandatory law, including EU package travel rules where they apply.
7. HollaSea Paid Services
7.1 What they are and how to buy them
HollaSea sells these services itself: skipper membership, request fees, Featured placements and vouchers. The price is the one shown on the relevant page at the time of purchase, VAT included where applicable.
Online checkout for these services is coming soon. Today, they are activated with a voucher code or by HollaSea. If you buy a service by contacting us, we tell you the price, how to pay and your right of withdrawal before you pay, and we confirm the price, the duration and your right of withdrawal to you by email before the service starts. We issue an invoice for each payment you make to HollaSea.
7.2 Skipper membership
You need an active membership to post voyages, share your free dates and send offers on requests. It also includes notifications about opportunities. The available membership periods are shown on the Membership page.
- A membership starts when it is activated and runs without a break until its end date.
- It does not renew automatically. You are never charged again without your own action.
- If you activate a new period while a membership is still active, the new period is added after the current end date.
7.3 Request fee
Publishing a request costs a one-time fee, shown before you publish. For a full voyage request, the fee is per person. For a skipper-only request, it is a flat fee per request. The fee covers publishing your request and notifying skippers. It does not guarantee that you will receive offers.
If we refuse to publish your request, or remove it, for a reason that is not your breach of these Terms, we refund the fee in full. If we remove it because it breaks these Terms, the fee is not refunded.
7.4 Featured
Featured listings are promoted listings chosen by HollaSea. They appear in a separate "Featured" section on the Voyages page, and a Featured voyage may also be shown in the featured spot on the homepage. Their position there is not a result of the normal ranking described in Section 8.
A Featured placement lasts for the period set when it is activated. It makes a voyage more visible. It does not guarantee applications, and it does not mean that HollaSea has checked the voyage or the skipper.
7.5 Vouchers
Vouchers are codes issued by HollaSea. A voucher either activates or extends a membership, or lets you publish a request without paying the fee. Each voucher can be used only for its purpose and up to its number of uses. Vouchers have no cash value. A free voucher cannot be exchanged for money or refunded. If you paid for a voucher, Section 7.6 applies.
Welcome offer. For a limited time, HollaSea may give each new account a free personal code: for example 6 months of skipper membership for skipper accounts, or 6 months of publishing requests without the fee for crew accounts. The code works only on the account it was given to, and only once. The period starts when you activate the code, the code must be activated by the date shown with it, and the period does not renew by itself. It is a free voucher, so the rules above apply.
7.6 Your 14-day right of withdrawal as a consumer
If you buy a HollaSea paid service as a consumer, you can withdraw from the contract within 14 days of the day it is concluded, without giving a reason (Government Emergency Ordinance no. 34/2014). To withdraw, send us a clear statement by email to office@hollasea.com before the 14 days end. You can use the model withdrawal form in our Cancellation & Refund Policy, but you do not have to. We refund what is due within 14 days of receiving your withdrawal, using the payment method you used, at no cost to you.
- Membership: if you asked us to start your membership during the withdrawal period and then withdraw, you pay only for the days already used, in proportion to the full price. We refund the rest.
- Request fee and Featured: the service is fully performed once your request or Featured placement is published. You lose the right of withdrawal after publication only if, before publication, you expressly asked for immediate publication and acknowledged that you would lose this right once the service was fully performed.
- If you did not give that request (and, for request fees and Featured, that acknowledgement): you can withdraw within the 14 days and get a full refund.
- Paid vouchers: if you have not used the voucher, we refund it in full. If you have used it, the rules above for the service it activated apply.
- Free vouchers: you paid nothing, so there is nothing to refund.
- Business buyers: these withdrawal rights do not apply if you buy for purposes related to your trade, business or profession, for example as a professional skipper or a charter company.
7.7 After the withdrawal period
After the withdrawal period, we do not refund the unused part of a paid service if you simply stop using it. We refund the unused part in proportion if:
- we close your account or stop the service for a reason that is not a serious breach of these Terms by you; or
- you close your account because you do not accept a change to these Terms (Section 16).
We also refund whenever the law requires it. A suspension does not stop a membership period from running. If we reverse a suspension or a closure because it was not justified, we add the lost days to your membership or, if you prefer, refund the unused part. Your legal rights if a paid service does not work as described (the legal guarantee of conformity) are not affected.
8. How We Rank and Show Results
These are the main things that decide the order in which results are shown:
- Boats: the default order is "Recommended". Boats are ranked first by the partner level of the charter company with HollaSea (Top partner, then Preferred, then Standard), which HollaSea sets, and then by the size of the current discount. "Recommended" is not a rating of the boat. You can also sort boats by price, length or year. We show boats only from charter companies that HollaSea has chosen to work with.
- Voyages: newest first by default. You can also sort them by departure date, by price or by the skipper's rating. Featured voyages appear in a separate "Featured" section above the list (Section 7.4). Within that section, they are ordered by the level of the Featured placement, then by departure date.
- Skippers: by average rating, then by number of voyages.
- Requests: newest first.
9. Member Conduct
9.1 Honest information
You must not misrepresent your identity, licences, qualifications, experience or legal authority to command a boat.
9.2 Community rules
You agree not to:
- post false, misleading, fraudulent or defamatory content, or fake reviews;
- ask for or arrange payment outside HollaSea for a boat booked on HollaSea, or otherwise try to avoid paying for HollaSea's paid services;
- harass, threaten or discriminate against other members, crew or charter companies;
- use the Platform for anything illegal, including drugs, weapons, smuggling, travel without valid documents, human trafficking or unauthorised commercial activity;
- upload viruses or malicious code, or disrupt the Platform;
- copy or collect data from the Platform by automated means (scraping), or use other members' contact details for anything other than the arrangement you are discussing with them;
- post content you do not have the right to share.
9.3 Responsibility for false declarations
If you give false, misleading or forged information about your qualifications, you are responsible under the law for any accident, damage, loss, fine or injury that results. You agree to compensate HOLLASEA S.R.L. for the claims, losses and reasonable legal costs that your false declaration causes it, to the extent they are caused by your fault.
10. Communication on HollaSea
- HollaSea has three kinds of chat: voyage group chats, request and offer chats, and skipper booking chats. Use each chat only for the voyage, request or booking it belongs to.
- Do not use HollaSea to arrange or promote anything illegal, including drugs, weapons, smuggling or travel without valid documents, and do not harass anyone.
- For boat bookings made on HollaSea, pay only through HollaSea. Voyage spots and skipper hire are paid directly to the skipper (Section 6).
- Messages stay in the conversation, where its participants can see them. If a member deletes their account, their messages stay in the conversation and are shown as sent by "Deleted user".
- We also keep a sealed archive of messages and account activity (for example sign-ins and changes to account details). It is kept for three (3) years and then deleted, as described in our Privacy Policy.
- Messages are checked automatically for certain words linked to illegal activity or to possible payment scams. A person on our team reviews every flagged message; messages are never removed automatically. We may also review a conversation when it is reported or when we receive a lawful request. We share conversations with authorities when the law requires it.
- You can report a conversation at any time with the Report button in the chat.
11. Your Content and Reviews
11.1 Ownership
You keep ownership of the text, photos, reviews and profile content you post.
11.2 Licence to HollaSea
When you post content, you give HollaSea a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and adapt it (for example, by resizing photos), ourselves or through our service providers. We use this licence only to show your content on the Platform, and in links, previews and search results that lead to its page on the Platform, while the content is published. We will use your content in advertising outside the Platform (for example, on social media) only with your separate consent.
The licence ends when you delete the content or your account. There are two exceptions: copies we must keep by law, and content that other members took part in (such as reviews, voyages and messages in shared conversations). That content may stay visible without your name, as described in our Privacy Policy.
11.3 Public content
Skipper profiles, voyages and reviews can be seen by other members and, in part, by visitors without an account.
11.4 Reviews
- Reviews must reflect a genuine, first-hand experience.
- Only crew accepted on a voyage can review its skipper, once per voyage, and only after the voyage has ended.
- Only members whose boat charter through HollaSea was confirmed and has ended can review that boat.
- Reviews are published when they are submitted. We publish every review that meets these rules, whether positive or negative. We do not edit reviews, and we do not pay or reward anyone for writing them. A skipper can publish a reply to a review.
- We may remove reviews that break these Terms, for example reviews that are fake, abusive or off-topic, or that contain other people's personal data. Section 12 applies.
12. Reporting Illegal Content and How We Moderate
12.1 How to report content
Anyone, with or without an account, can tell us about content on the Platform that they believe is illegal or breaks these Terms. This includes boat listings, voyages, profiles, reviews, requests, skipper ads and messages.
- Email office@hollasea.com with the subject "Report".
- Members can also report a conversation with the Report button in the chat ("Report this conversation").
In your report, please include:
- why you think the content is illegal or breaks these Terms;
- the exact link to it, or a clear description of where it is;
- your name and email address, unless the report concerns child sexual abuse material;
- a statement that you believe in good faith that the information in your report is accurate and complete.
We confirm that we have received your report. We review it carefully, objectively and without undue delay. We then tell you what we decided and how you can contest the decision.
12.2 How we moderate
If content or an account is illegal or breaks these Terms, we may:
- remove the content; or
- suspend or close the account. While an account is suspended, the member cannot sign in, and their voyages, requests and skipper ads are hidden.
People on our team take these decisions. We use automated keyword checks only to flag messages for a person to review. We do not take moderation decisions by automated means.
12.3 Reasons and how to contest
If we remove your content, or suspend or close your account, we tell you the reasons by email, unless the law prevents us. We tell you:
- what we did, and for how long;
- the facts we relied on;
- whether automated means were used to detect the content;
- which rule in these Terms, or which law, we applied;
- how you can contest the decision.
You can contest a decision by writing to office@hollasea.com within six months of it. A person will review your complaint, and we will tell you the outcome. You can also go to court or use the other options in Section 17.
12.4 Safety
If we become aware of information suggesting a criminal offence that threatens someone's life or safety, we will inform the competent authorities.
13. Account Suspension and Termination
13.1 By us
We may suspend or close your account if you:
- seriously or repeatedly break these Terms;
- give fraudulent information, including fake licences or qualifications;
- operate without a legal authorisation that you need;
- put the safety of others at risk.
We will tell you the reasons and how to contest them (Section 12.3). Where possible, we will warn you first. In serious cases (fraud, safety risks, illegal content) we may act immediately. If you use the Platform as a business, Section 14 also applies.
13.2 Inactive accounts
If you do not log in for 2 years, your account is anonymised automatically, in the same way as when you delete it (Section 13.3).
13.3 By you
You can delete your account at any time in Settings → Privacy & data. If you have an upcoming boat booking or voyage, as skipper or as accepted crew, you cannot delete the account straight away. You can send a deletion request from the same page, and we will handle it.
When your account is deleted, your profile is anonymised: your name is replaced with "Deleted user", and your contact details, profile details and photos are removed from your profile. Health or dietary information you added to voyage applications is removed. Some records are kept for the periods set out in our Privacy Policy, such as invoices and payment records, consent records and the sealed archive of messages and account activity.
If you have a charter company account, deleting or anonymising the account does not automatically remove your company profile or your open skipper ads. Close or delete your skipper ads before you delete your account, or email office@hollasea.com and we will remove them.
Deleting your account does not cancel your bookings or refund paid services, except as set out in Sections 4 and 7.
14. Business Users
If you use the Platform for your trade, business or profession (for example, with a charter company account, or as a skipper acting as a trader):
- the consumer rights in these Terms, such as the right of withdrawal and the right to go to the courts where you live, do not apply to you;
- we give you at least 30 days' notice, with our reasons, before we close your account, unless the law allows us to act immediately, for example because of repeated breaches or a legal obligation;
- we tell you about changes to these Terms at least 15 days before they take effect (Section 16);
- Section 8 explains the main parameters that decide the order of results, including the partner levels HollaSea gives charter companies;
- you can see in your account the data you provide and the applications, bookings and messages linked to your listings; after your account ends, we keep only the records described in our Privacy Policy;
- you can send complaints to office@hollasea.com.
15. Liability
15.1 What we are responsible for
We are responsible for providing our own services with reasonable care and skill and in line with these Terms, and for handling the payments you make to HollaSea as described in Section 4. For boats, we take reasonable care to show the charter company's information accurately and to pass on your booking and payments correctly, and we are responsible if we do not.
Unless we failed to meet our own obligations, we are not responsible for the boat, the voyage or any other service provided by charter companies, skippers or other members, including delays and cancellations they decide, or for weather and sea conditions.
15.2 Platform availability and information from others
We work to keep the Platform available and accurate, but we cannot guarantee that it will always be available, uninterrupted or error-free. Information about boats comes from charter companies. Information in profiles, voyages and requests comes from members. We are not responsible for that information unless we knew it was illegal or false and did not act.
15.3 What we never exclude
Nothing in these Terms excludes or limits our liability for:
- death or personal injury;
- fraud;
- gross negligence or wilful misconduct;
- any other liability that cannot be excluded or limited by law.
Nothing in these Terms affects your statutory rights as a consumer.
15.4 Other limits
Subject to Section 15.3, if we cause you loss through simple (slight) negligence, we are liable only for damage to your property and financial loss that was foreseeable and is a direct result of our failure, and not for indirect loss such as loss of profit or of business. Where the loss relates to a booking or service you paid HollaSea for, our liability for it is limited to the total amount you paid to HollaSea for that booking or service.
This limit does not apply to amounts we hold for you, or that we must refund or pass on to you under these Terms.
16. Changes to These Terms
We may change these Terms only:
- to reflect a change in the law or a decision of an authority;
- to add, change or remove Platform features or services;
- to address security or fraud risks;
- to correct errors or make the wording clearer.
For changes that affect them, we tell members by email and with a notice on the Platform at least 15 days before the changes take effect. A change may take effect immediately only when it is needed for legal or security reasons. We will still tell you about it.
If you do not agree with a change, you can close your account before it takes effect. If you have a paid service that is still running, we then refund the unused part in proportion (Section 7.7). If you do not close your account, the updated Terms apply to you from the date they take effect.
Changes do not apply retroactively, and they do not affect bookings already confirmed or periods already paid for. The date at the top of this page shows the current version.
17. Governing Law, Complaints and Dispute Resolution
17.1 Governing law
These Terms are governed by Romanian law. If you are a consumer, this does not take away the protection of the mandatory rules of the law of the country where you normally live.
17.2 Courts
If you are a consumer, you can bring a claim before the courts of Romania or of the place where you live. We can bring claims against you only before the courts of the place where you live. If you use the Platform as a business, disputes will be settled by the competent courts of Bucharest, Romania.

17.4 Consumer authorities and out-of-court dispute resolution

- You can try to settle a dispute out of court through the alternative dispute resolution procedure (SAL). See anpc.ro/sal.
- Consumers living in another EU country can also ask the European Consumer Centre in their country for help with a cross-border complaint.
- If you live in another EU country, the European Consumer Centre in your country can help with cross-border disputes.
